TRADE PRACTICES ACT 1974 (‘THE ACT’)
Where implied conditions and warranties cannot be excluded, any liability for breach of such conditions
and warranties (other than section 69 of the Act), shall be limited, to the replacement of the product/s or acquiring equivalent product/s.
LIMITATION OF LIABILITY
Our total liability arising out of or in connection with the purchase or these terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the most recent purchase price paid by you under these terms or where you have not paid for the purchase, then the total liability of us is the resupply of information or purchase to you.
SEVERANCE
If any part of these Terms and Conditions is deemed invalid or unenforceable by a court of competent jurisdiction, the validity of the remaining Terms and Conditions shall not be affected.
FORCE MAJEURE
We shall not be liable for any delay in performing our obligations under these Terms and Conditions, if such delay is caused by circumstances beyond the reasonable control of us.
NO WAIVER
No waiver of or variation to the Terms and Conditions will be binding on the parties unless it is in writing and signed by both parties.
GOVERNING LAW
These Terms and Conditions shall be governed by the laws of Queensland and shall be subject to the non-exclusive jurisdiction of the courts of Queensland.
STATUTORY GUARANTEES AND WARRANTIES TO CONSUMERS
Schedule 2 of the Competition and Consumer Act 2010 (“C&C Act”) defines a consumer. Under the C&C Act we are a supplier of product/s to you, and as a consumer the C&C Act gives you statutory guarantees.

By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.
